Terms of Service
These terms govern your use of the-pros.net and the matching service offered through it. By using the site or submitting the quote form, you agree to them. If you do not agree, please do not use the service.
The site is operated by [LEGAL ENTITY NAME], [MAILING ADDRESS] (“The-Pros”, “we”, “us”).
1. What this service is — and what it is not
The-Pros.net is a free matching service. We take the details of your project and introduce you to one independent contractor who serves your area and does that kind of work.
We want to be blunt about the limits of that:
- We are not a contractor. We do not perform, supervise, manage, inspect or warrant any construction, renovation or repair work.
- We are not a party to your agreement with a contractor. Any quote, contract, schedule, price, change order, warranty or dispute is strictly between you and them.
- We do not set prices and we do not receive a share of what you pay a contractor.
- We do not guarantee any outcome — that a contractor will call you, quote you, take the job, finish it, or finish it well.
2. How contractors are vetted, and what that means
Before a contractor joins the network we check that they hold the licence and insurance their jurisdiction requires for the work they do, and we review their rating history. We remove contractors with unresolved complaints.
That vetting is a reasonable-efforts screening at a point in time. It is not a guarantee of workmanship, of current licensing or insurance status, of solvency, or of conduct. Licences lapse and cover gets cancelled without anyone telling us. Verify licence and insurance yourself before any work starts — every US state and Canadian province has a public licence lookup — and get the quote and scope in writing.
3. Your side of it
By submitting the form you confirm that:
- You are at least 18 and legally able to enter a contract.
- The information you give us is true, and the phone number and email are yours to give.
- You own the property or are authorised to arrange work on it.
- You are making a genuine enquiry about real work, not testing, scraping or spamming the form.
You may not use the site to submit anyone else’s details, to interfere with the service, or to collect information about contractors in the network for a competing purpose.
4. Consent to be contacted
When you submit the form you see a consent statement and, by clicking the button, agree to it. In plain terms: you consent to be contacted by The-Pros.net and by the one contractor we match you with, at the phone number and email you gave us, by call, text and email, including with automated technology and pre-recorded messages, about your project.
That consent is not a condition of any purchase. Message and data rates may apply. You can withdraw it at any time: reply STOP to a text, use the unsubscribe link in an email, or tell a caller to stop. Once a contractor has your details you will also need to tell them directly — we cannot withdraw consent on your behalf with a third party. We keep a record of the consent wording shown to you and when you submitted.
5. Privacy
What we collect and who we pass it to is set out in our Privacy Policy, which forms part of these terms. The short version: your request goes to one matched contractor, and we do not sell your details to lead lists.
6. The site itself
Content on this site — text, layout, logos, and the project photography supplied to us by contractors in the network — belongs to us or to the contractor who supplied it, and may not be copied or reused without permission. Before-and-after photographs show real projects completed by contractors in the network; they illustrate the kind of work available and are not a promise of a particular result, finish, timeline or price for your project.
Any statistics or ratings shown are indicative aggregates and are not a forecast of what will happen with your enquiry.
7. Availability
We aim to keep the site up but do not promise it will be uninterrupted or error-free, and we may change or withdraw any part of it. Coverage varies: for some ZIP codes there may be no matching contractor, in which case we will tell you and your request goes no further.
8. Disclaimers and limits on liability
The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, property damage, personal injury, or the acts, omissions, delays, defective work or insolvency of any contractor. Our total aggregate liability arising out of or relating to the service is limited to one hundred US dollars (US$100).
Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for death or personal injury caused by our negligence, where the law does not permit that limit.
9. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms, from information you submit that is not yours to submit, or from your dealings with a contractor.
10. Governing law and disputes
These terms are governed by the laws of [STATE / PROVINCE], without regard to conflict-of-laws rules, and the courts of [VENUE] have exclusive jurisdiction. If you have a problem, contact us first at [email protected] — most things are settled that way.
11. Changes
We may update these terms; the date at the top shows when. Continuing to use the site after a change means you accept the updated terms.
